Welcome to Travelstart+<\/h1>\n\n<p>\nTRAVELSTART ONLINE TRAVEL OPERATIONS (PTY) LTD (&#8220;Travelstart&#8221;, &#8220;We&#8221;, &#8220;us&#8221; or &#8220;Our&#8221;) is excited\nto welcome you (the Subscriber) to Travelstart+, your one-stop travel assistant.\nTravelstart+ is a premium subscription service whereby you gain access to exclusive discounted\ntravel benefits through upgrading to Travelstart+.\n<\/p>\n\n<p><strong>\nPLEASE BE ADVISED: TRAVELSTART IS AN APP-ONLY PRODUCT THAT CAN BE DOWNLOADED THROUGH YOUR APP STORE.\nFrom there you will be able to upgrade your subscription to Travelstart+.\n<\/strong><\/p>\n\n<p>\nBy downloading, updating, accessing and\/or using the Travelstart+ application, you agree to these\nTerms and Conditions of Use (&#8220;Terms of Service&#8221;).\n<\/p>\n\n<p>\nWhere a Subscriber is under the age of 18 years, you warrant that when completing the application\nprocess, you were duly assisted by your parent or legal guardian who ratifies your subscription.\n<\/p>\n\n<p>\nIf you subscribe on behalf of a juristic entity, you warrant that you are duly authorised to act on\nits behalf and that you will not use Travelstart+ for any commercial purpose.\n<\/p>\n\n<hr>\n\n<h2>2. Terms and Conditions<\/h2>\n\n<h3>a. Registration Process<\/h3>\n\n<p>\nOnly registered users are able to access Travelstart+ and claim their travel discount credit.\n<\/p>\n\n<p>During registration you will be required to provide:<\/p>\n\n<ul>\n    <li>First name<\/li>\n    <li>Surname<\/li>\n    <li>Phone number<\/li>\n    <li>Email address<\/li>\n    <li>Password<\/li>\n<\/ul>\n\n<p>\nThe above constitutes your Personal Information.\n<\/p>\n\n<p>\nIt is the Subscriber&#8217;s responsibility to safeguard their password.\nTravelstart accepts no liability for any loss arising from incorrect information\n(including Personal Information) supplied by the Subscriber.\n<\/p>\n\n<h3>b. Exclusive Discounted Travel Benefits<\/h3>\n\n<p>\nFor purposes of these Terms, &#8220;Travel Voucher&#8221; refers to the travel discount benefits provided\nto you after payment of the annual subscription fee.\n<\/p>\n\n<p>\nAlthough referred to as vouchers, these travel benefits:\n<\/p>\n\n<ul>\n    <li>Are issued only after payment of the annual Subscription Amount.<\/li>\n    <li>Have no monetary value.<\/li>\n    <li>May only be used as described in these Terms.<\/li>\n    <li>Cannot be exchanged for cash or any other monetary amount.<\/li>\n<\/ul>\n\n<p>\nUpon payment of the Subscription Amount, you receive:\n<\/p>\n\n<ul>\n    <li>Access to Travelstart+ for up to one year.<\/li>\n    <li>Travel Vouchers with a combined value of up to <strong>R5,000.00<\/strong>.<\/li>\n<\/ul>\n\n<h3>c. Value of Travel Vouchers<\/h3>\n\n<p>\nYour Subscription includes Travel Vouchers totalling <strong>R5,000.00<\/strong>, consisting of:\n<\/p>\n\n<ul>\n    <li>2 \u00d7 R1,000 International Flight Vouchers<\/li>\n    <li>2 \u00d7 R500 Domestic Flight Vouchers<\/li>\n    <li>4 \u00d7 R500 Domestic Hotel Vouchers (South African hotels only)<\/li>\n<\/ul>\n\n<p>\nWhen making an eligible booking through Travelstart, one applicable Travel Voucher will be\nautomatically applied.\n<\/p>\n\n<p>\nThe following conditions apply:\n<\/p>\n\n<ul>\n    <li>Only one Travel Voucher may be used per booking.<\/li>\n    <li>Voucher usage is limited to its stated travel benefit.<\/li>\n    <li>You remain responsible for paying any remaining booking balance.<\/li>\n<\/ul>\n\n<h3>d. Subscriber Registration<\/h3>\n\n<p>\nAccess to Travelstart+ is granted only after:\n<\/p>\n\n<ol>\n    <li>Successfully completing registration.<\/li>\n    <li>Paying the full annual Subscription Amount upfront.<\/li>\n<\/ol>\n\n<p>\nThe Subscription commences on the date payment is received.\n<\/p>\n\n<h4>i. Annual Subscription Payment<\/h4>\n\n<p>\nThe Subscription Amount must be paid upfront and in full using the payment method selected during registration.\n<\/p>\n\n<h4>ii. Subscription Amount<\/h4>\n\n<p>\nThe Subscription Amount will be displayed during registration.\nTravelstart reserves the right to amend the annual subscription fee and will notify subscribers\nthrough the Travelstart app before any increase becomes effective.\n<\/p>\n\n<h3>e. Subscription Period<\/h3>\n\n<p>\nUpon payment, Travelstart grants you a non-exclusive, non-transferable right to access\nTravelstart+ for one year from the payment date.\n<\/p>\n\n<h3>f. Automatic Renewal<\/h3>\n\n<p>\n<strong>\nSubscriptions automatically renew for additional Subscription Periods unless cancelled in\naccordance with these Terms.\nRenewal includes automatic billing for the next Subscription Period.\n<\/strong>\n<\/p>\n\n<h3>g. Termination<\/h3>\n\n<p>\nEither you or Travelstart may terminate the Subscription after the initial 7-day cooling-off\nperiod by giving at least <strong>30 calendar days&#8217; written notice<\/strong>.\n<\/p>\n\n<p>\nSubscription fees already paid for the current Subscription Period are non-refundable.\nHowever, you may continue using Travelstart+ until the end of the paid Subscription Period.\n<\/p>\n\n<h4>i. Cooling-Off Period<\/h4>\n\n<p>\nIn accordance with the Electronic Communications and Transactions Act 25 of 2002,\nyou may cancel your Subscription within seven (7) days of your initial subscription.\n<\/p>\n\n<p>\nYou will receive:\n<\/p>\n\n<ul>\n    <li>A refund of the Subscription Amount;<\/li>\n    <li>Less the value of any Travel Vouchers already used;<\/li>\n    <li>Less the applicable Cancellation Fee.<\/li>\n<\/ul>\n\n<p>\nRefunds will be paid to the same bank account used for payment within 30 days after\nTravelstart receives your cancellation notice.\n<\/p>\n\n<h4>ii. Breach<\/h4>\n\n<p>\nIf payment for a renewed Subscription fails, Travelstart may:\n<\/p>\n\n<ul>\n    <li>Attempt to recover outstanding amounts;<\/li>\n    <li>Suspend your Subscription;<\/li>\n    <li>Exercise any other legal remedies available.<\/li>\n<\/ul>\n\n<h3>h. Use of Travelstart Services<\/h3>\n\n<p>\nTravelstart provides access to travel services supplied by third-party travel providers.\n<\/p>\n\n<p>You acknowledge that:<\/p>\n\n<ol>\n    <li>\n        Third-party providers are solely responsible for delivering the travel services booked.\n    <\/li>\n    <li>\n        Travelstart acts only as an agent and does not own or operate transport services.\n    <\/li>\n    <li>\n        You indemnify Travelstart against claims arising from failures by third-party providers.\n    <\/li>\n<\/ol>\n\n<p>\nBookings made through Travelstart+ are also subject to the Travelstart Services Terms and Conditions.\n<\/p>\n\n<h3>i. Trademarks and Intellectual Property<\/h3>\n\n<p>\nAll intellectual property rights in the Travelstart+ service, including patents, copyright,\ndesigns, trademarks, trade secrets and proprietary know-how, remain the property of Travelstart\nor its licensors.\n<\/p>\n\n<p>\nNothing in these Terms transfers ownership of intellectual property to the Subscriber.\n<\/p>\n\n<p>\nThe Travelstart and Travelstart+ brands remain protected by applicable law and may not be used\nwithout permission.\n<\/p>\n\n<h3>j. Protecting Your Data<\/h3>\n\n<p>\nTravelstart processes Personal Information in accordance with the Protection of Personal\nInformation Act (POPIA) and its Privacy Policy.\n<\/p>\n\n<p>\nCertain Personal Information must be processed to complete bookings through travel service providers.\n<\/p>\n\n<p>\nBookings are also governed by the applicable travel provider&#8217;s own terms and conditions.\n<\/p>\n\n<h3>k. Geographic Limitation<\/h3>\n\n<p>\nTravelstart+ may only be available in the country where your Subscription was registered.\n<\/p>\n\n<h3>l. Limitation of Liability<\/h3>\n\n<p>\nTravelstart, its directors, officers, employees and agents shall not be liable for any claims,\nlosses, damages or injuries (including indirect or consequential damages) arising from the use\nof Travelstart+.\n<\/p>\n\n<h3>m. Disclaimer<\/h3>\n\n<p>\nTravelstart+ is provided on an &#8220;as is&#8221; basis and may be affected by limitations or delays\nassociated with the internet and electronic communications.\n<\/p>\n\n<p>\nTravelstart is not liable for downtime or interruptions beyond its reasonable control.\n<\/p>\n\n<h3>n. Changes to these Terms<\/h3>\n\n<p>\nTravelstart may amend these Terms at its discretion.\n<\/p>\n\n<p>\nWhere a material amendment occurs, subscribers will receive at least one month&#8217;s notice before\nthe effective date.\n<\/p>\n\n<p>\nUpdated Terms will be published in the Travelstart+ application with the applicable effective date.\nContinued use of Travelstart+ after that date constitutes acceptance of the amended Terms.\n<\/p>\n\n<h3>o. Material Changes<\/h3>\n\n<p>\nA material change includes, but is not limited to:\n<\/p>\n\n<ul>\n    <li>Changes to Subscription pricing.<\/li>\n    <li>Changes to the value of Travel Vouchers.<\/li>\n    <li>Changes to other essential terms of the agreement.<\/li>\n<\/ul>\n\n<h3>p. Legal<\/h3>\n\n<h4>i. Governing Law<\/h4>\n\n<p>\nThese Terms are governed by the laws of South Africa.\n<\/p>\n\n<h4>ii. Incorporated Documents<\/h4>\n\n<p>\nThese Terms incorporate any Privacy Policy and other referenced terms of use.\n<\/p>\n\n<h4>iii. Assignment<\/h4>\n\n<p>\nTravelstart may assign or transfer its rights and obligations at any time.\nSubscribers may not assign or transfer any rights arising from their Subscription.\n<\/p>\n\n<h4>iv. Travel Service Providers<\/h4>\n\n<p>\nOnce a booking is made through Travelstart+, travel services are supplied directly by the\nrelevant Travel Service Provider.\n<\/p>\n\n<p>\nTravelstart is not liable for any loss or damage caused by a Travel Service Provider.\n<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Version 4, February 2025 1.
