1. Welcome to Travelstart+
TRAVELSTART ONLINE TRAVEL OPERATIONS (PTY) LTD (“Travelstart”, “We”, “us” or “Our”) is excited to welcome you (the Subscriber) to Travelstart+, your one-stop travel assistant. Travelstart+ is a premium subscription service whereby you gain access to exclusive discounted travel benefits through upgrading to Travelstart+.
PLEASE BE ADVISED: TRAVELSTART IS AN APP-ONLY PRODUCT THAT CAN BE DOWNLOADED THROUGH YOUR APP STORE. From there you will be able to upgrade your subscription to Travelstart+.
By downloading, updating, accessing and/or using the Travelstart+ application, you agree to these Terms and Conditions of Use (“Terms of Service”).
Where a Subscriber is under the age of 18 years, you warrant that when completing the application process, you were duly assisted by your parent or legal guardian who ratifies your subscription.
If you subscribe on behalf of a juristic entity, you warrant that you are duly authorised to act on its behalf and that you will not use Travelstart+ for any commercial purpose.
2. Terms and Conditions
a. Registration Process
Only registered users are able to access Travelstart+ and claim their travel discount credit.
During registration you will be required to provide:
- First name
- Surname
- Phone number
- Email address
- Password
The above constitutes your Personal Information.
It is the Subscriber’s responsibility to safeguard their password. Travelstart accepts no liability for any loss arising from incorrect information (including Personal Information) supplied by the Subscriber.
b. Exclusive Discounted Travel Benefits
For purposes of these Terms, “Travel Voucher” refers to the travel discount benefits provided to you after payment of the annual subscription fee.
Although referred to as vouchers, these travel benefits:
- Are issued only after payment of the annual Subscription Amount.
- Have no monetary value.
- May only be used as described in these Terms.
- Cannot be exchanged for cash or any other monetary amount.
Upon payment of the Subscription Amount, you receive:
- Access to Travelstart+ for up to one year.
- Travel Vouchers with a combined value of up to R5,000.00.
c. Value of Travel Vouchers
Your Subscription includes Travel Vouchers totalling R5,000.00, consisting of:
- 2 × R1,000 International Flight Vouchers
- 2 × R500 Domestic Flight Vouchers
- 4 × R500 Domestic Hotel Vouchers (South African hotels only)
When making an eligible booking through Travelstart, one applicable Travel Voucher will be automatically applied.
The following conditions apply:
- Only one Travel Voucher may be used per booking.
- Voucher usage is limited to its stated travel benefit.
- You remain responsible for paying any remaining booking balance.
d. Subscriber Registration
Access to Travelstart+ is granted only after:
- Successfully completing registration.
- Paying the full annual Subscription Amount upfront.
The Subscription commences on the date payment is received.
i. Annual Subscription Payment
The Subscription Amount must be paid upfront and in full using the payment method selected during registration.
ii. Subscription Amount
The Subscription Amount will be displayed during registration. Travelstart reserves the right to amend the annual subscription fee and will notify subscribers through the Travelstart app before any increase becomes effective.
e. Subscription Period
Upon payment, Travelstart grants you a non-exclusive, non-transferable right to access Travelstart+ for one year from the payment date.
f. Automatic Renewal
Subscriptions automatically renew for additional Subscription Periods unless cancelled in accordance with these Terms. Renewal includes automatic billing for the next Subscription Period.
g. Termination
Either you or Travelstart may terminate the Subscription after the initial 7-day cooling-off period by giving at least 30 calendar days’ written notice.
Subscription fees already paid for the current Subscription Period are non-refundable. However, you may continue using Travelstart+ until the end of the paid Subscription Period.
i. Cooling-Off Period
In accordance with the Electronic Communications and Transactions Act 25 of 2002, you may cancel your Subscription within seven (7) days of your initial subscription.
You will receive:
- A refund of the Subscription Amount;
- Less the value of any Travel Vouchers already used;
- Less the applicable Cancellation Fee.
Refunds will be paid to the same bank account used for payment within 30 days after Travelstart receives your cancellation notice.
ii. Breach
If payment for a renewed Subscription fails, Travelstart may:
- Attempt to recover outstanding amounts;
- Suspend your Subscription;
- Exercise any other legal remedies available.
h. Use of Travelstart Services
Travelstart provides access to travel services supplied by third-party travel providers.
You acknowledge that:
- Third-party providers are solely responsible for delivering the travel services booked.
- Travelstart acts only as an agent and does not own or operate transport services.
- You indemnify Travelstart against claims arising from failures by third-party providers.
Bookings made through Travelstart+ are also subject to the Travelstart Services Terms and Conditions.
i. Trademarks and Intellectual Property
All intellectual property rights in the Travelstart+ service, including patents, copyright, designs, trademarks, trade secrets and proprietary know-how, remain the property of Travelstart or its licensors.
Nothing in these Terms transfers ownership of intellectual property to the Subscriber.
The Travelstart and Travelstart+ brands remain protected by applicable law and may not be used without permission.
j. Protecting Your Data
Travelstart processes Personal Information in accordance with the Protection of Personal Information Act (POPIA) and its Privacy Policy.
Certain Personal Information must be processed to complete bookings through travel service providers.
Bookings are also governed by the applicable travel provider’s own terms and conditions.
k. Geographic Limitation
Travelstart+ may only be available in the country where your Subscription was registered.
l. Limitation of Liability
Travelstart, its directors, officers, employees and agents shall not be liable for any claims, losses, damages or injuries (including indirect or consequential damages) arising from the use of Travelstart+.
m. Disclaimer
Travelstart+ is provided on an “as is” basis and may be affected by limitations or delays associated with the internet and electronic communications.
Travelstart is not liable for downtime or interruptions beyond its reasonable control.
n. Changes to these Terms
Travelstart may amend these Terms at its discretion.
Where a material amendment occurs, subscribers will receive at least one month’s notice before the effective date.
Updated Terms will be published in the Travelstart+ application with the applicable effective date. Continued use of Travelstart+ after that date constitutes acceptance of the amended Terms.
o. Material Changes
A material change includes, but is not limited to:
- Changes to Subscription pricing.
- Changes to the value of Travel Vouchers.
- Changes to other essential terms of the agreement.
p. Legal
i. Governing Law
These Terms are governed by the laws of South Africa.
ii. Incorporated Documents
These Terms incorporate any Privacy Policy and other referenced terms of use.
iii. Assignment
Travelstart may assign or transfer its rights and obligations at any time. Subscribers may not assign or transfer any rights arising from their Subscription.
iv. Travel Service Providers
Once a booking is made through Travelstart+, travel services are supplied directly by the relevant Travel Service Provider.
Travelstart is not liable for any loss or damage caused by a Travel Service Provider.
