Travelstart Plus: Terms and Conditions

1. Welcome to Travelstart+

TRAVELSTART ONLINE TRAVEL OPERATIONS (PTY) LTD (“Travelstart”, “We”, “us” or “Our”) is excited to welcome you (the Subscriber) to, Travelstart +, your one-stop travel assistant. Travelstart + is a premium subscription service whereby you will gain access to exclusive discounted travel benefits through upgrading to Travelstart +. PLEASE BE ADVISED, TRAVELSTART IS AN APP-ONLY PRODUCT, THAT CAN BE DOWNLOADED THROUGH YOUR APP STORE. From there you will be able to upgrade your subscription to Travelstart +.

By downloading, updating, accessing and/or using the Travelstart Application you agree to these terms and conditions of use (Terms of Service). Where a Subscriber is under the age of 18 years, you warrant that when completing the application process, you were duly assisted by your Parent or Legal Guardian who in turn ratifies your Subscription. In the event that you are subscribing on behalf of a Juristic entity, you warrant to us that you are duly authorised to act for and on their behalf, and warrant that you will not use Travelstart + for any commercial purpose.

2. Terms and Conditions

1. Registration Process. Only registered users are able to gain access to Travelstart + and claim their Travel discount Credit. During the registration process, you will be asked to provide your First name, Surname and contact details (including phone contact details and email address) and will be asked to create a password (Personal Information). It is the Subscriber's responsibility to ensure the safekeeping of such passwords. Travelstart accepts no liability for any loss incurred as a result of incorrect information (including Personal Information) provided by you (as the Subscriber) to us.
2. Exclusive Discounted Travel Benefits. For the purpose of these Travelstart + terms and conditions, “Travel Voucher" shall mean the following. Whilst we may refer to the travel discounted credit as a voucher, you agree and understand that such travel benefits are only provided by us to you in response to you paying the annual Subscription Amount in full. You acknowledge that the Travel Voucher(s) has/have no monetary value and as such can only be used for the purposes as set out herein. Such Travel Vouchers will NOT be exchangeable for cash or any other monetary amount. Upon making payment of the Subscription Amount, you will receive access to Travelstart + which shall include the Travel Vouchers in an amount of no more than R5,000.00 (Five Thousand) together with a right of access to Travelstart + for a period of 1 year (calculated from the date of payment of the Subscription).
   Value of Travel Voucher. In response to paying your Subscription Fee, you will receive Travel Vouchers amounting to R5,000.00 which shall be issued as follows:
   1. 2 x R1000 International Flight Voucher
   2. 2 x R500 Domestic Flight Voucher; and
   3. 4 x R500 Domestic Hotel Vouchers (only applicable to local South African Hotels).
   In the event of you purchasing Travelstart +, when making a booking through Travelstart, we will automatically apply one of the Travel Vouchers towards such Booking (mentioned above). The Travel Vouchers shall only be used by you when making a booking using Travelstart + and at all times will be subject to the amount and travel benefit reflected on such Travel Voucher. You understand that you will be restricted to only being able to use one Travel Voucher per booking. The above notwithstanding, you will remain liable for the remaining portion of the Booking amount not settled through the use of the Travel Voucher.
3. Subscriber Registration. Access to Travelstart + will only be provided in response to the Subscriber accurately completing the registration process AND making payment of the Annual Subscription amount due upfront and in full. For the sake of clarity, the date of payment of the Subscription Amount shall be the commencement date of your Subscription.
   1. How do I pay the Annual Subscription: The Annual Subscription Amount must be paid upfront and in full. Payment can be made to us using the payment method selected by the Subscriber during the application process.
   2. Subscription Amount. The Subscription Amount will be made available to you through the registration process. We reserve the right to adjust the annual Subscription Fee, but will always inform you (through the Travelstart App) of such adjustments prior to such adjustments being implemented.
4. Subscription Period. Once payment of the annual subscription amount has been made in full, we will grant you a non-exclusive, non-transferable right of access and use to Travelstart + Services (“Subscription”). Your subscription will commence from the date of payment of the Subscription Amount, and endure for one year (“Subscription Period), thereafter
5. Auto renewal of Subscription Period. Your attention is specifically drawn to: All Subscriptions to Travelstart + are automatically renewed by an additional Subscription Period (which will include debiting your account for the further Subscription Period) at a time until either you, or Travelstart, terminates the Subscription in accordance with clause (f) below.
6. Termination. Travelstart or You may at any time, after the initial 7 calendar days from the date of payment of the initial Subscription Amount (as mentioned below), be able to terminate the subscription by providing no less than 30 (Thirty) calendar days prior written notice to the other Party. No Subscription Amount paid in advance (for the applicable Subscription Period) will be refunded to you. HOWEVER you will continue to have access to and make use of your Travelstart + subscription
   1. Cooling Off Period. Notwithstanding anything to the contrary, you are advised, in terms of the Electronic Communications and Transaction Act, 25 of 2002, that you have a right to terminate your Subscription, within 7 days of initially subscribing to Travelstart +(Cooling Off Period). In this case you will be entitled to a full refund of the Subscription Amount less the value of Travel Vouchers, which you utilised during the aforementioned 7 day cooling off period, as well as an administrative fee (Cancellation Fee). The Cancellation Fee will be calculated as at the date of cancellation. Any refund flowing from this clause 2(d)(ii) shall be paid into the same bank account used to make payment of the Annual Subscription amount within 30 days from the date on which you notified us (in terms of this clause 2(d)(ii)) of your intention to exercise your cooling off period.
   2. Breach. In the event of non-payment of the Subscription Amount, where you have not terminated/cancelled your Subscription within 1 month prior to the end of your Subscription Period, we reserve the right to recover any outstanding payment at the same time at which the Annual Subscription would have been due to us. If payment of the annual Subscription Amount fails, we will make further attempts to recover the Subscription Amount, which shall be done without prejudice to any other available rights to us. In addition, to the above, we reserve the right to suspend your subscription in the event of non-payment.
7. Use of the Travelstart Services. You understand and agree that we may offer Services which are provided by and in conjunction with Third Parties (whom we act as agents for) travel service providers. With this in mind, you understand and agree:
   1. The third Party travel provider will be responsible for all obligations in so far as executing the Services for which you booked using Travelstart +.
   2. As a result of the above, you agree to indemnify us against any loss, damage or claim arising through the Third Party in not providing the services for which they are responsible for.
   For the sake of clarity, when booking through the Travelstart + App you agree to be bound by the terms and conditions of use for Travelstart Services.
8. Trademarks and Intellectual Property Rights. Ownership and all Intellectual Property Rights in the service or any content provided through the Travelstart + application , including (but not limited to) patents, design rights, copyrights, trademarks, trade-secrets and proprietary know-how, shall be owned by and vested in Travelstart. Nothing contained in these terms and conditions will be interpreted as a transfer of such rights from Travelstart to You.

   Specifically, the Travelstart Brand, which shall include Travelstart +, appearing on the Travelstart + application remains (at all times) the property of Travelstart + or its licensors, and as such are protected by applicable laws. Use of these Trademarks is by all means prohibited.

9. Protecting your Data. Travelstart is committed to the protection of your Personal Information in accordance with POPI and will process your Personal Information in accordance with our PRIVACY POLICY. You acknowledge that to provide you with services booked through our Travel Services Providers this will require certain Personal information to be processed in order to finalise your booking. Your attention is specifically drawn to the Travel Service Providers terms and conditions of carriage/use, which will be used to govern the relationship between the Travel Service Provider and you (the Subscriber) in so far as the travel services are concerned.
10. Limitation on Travelstart Plus. Use of Travelstart Plus may be limited to the country in which you have registered for Travelstart Plus.
11. Limitation of Liability. Travelstart, its officers, directors, servants or agents will under no circumstances be liable for any claim, loss, damage or injury (which shall include indirect and/or indirect damages) suffered by any persons arising from the use of Travelstart Plus.
12. Disclaimer. Travelstart Plus is provided “as is” and may be subject to limitations or delays inherent with the use of the Internet and electronic communications. Under no circumstances will Travelstart be liable for any downtime caused as a result of the above or through any other occurrence beyond the reasonable control of Travelstart.
13. Travelstart may modify these terms and conditions at any time, under its discretion. Only where there is a material change to these terms and conditions, will you (subscriber) be notified of such change one month prior to the effective date of such change. Any change/amendment to these terms and conditions will be posted on the Travelstart + application. At the beginning of each amended set of terms and conditions, the effective date of such amendment will be posted on the front page of the terms and conditions. You, as a Subscriber, agree to the continued access to Travelstart+ on the date recorded as the Effective Date of such change.
14. For the avoidance of doubt in regard to the above clause, a material change will be deemed to mean any change to the essentials of the Agreement, including (but not limited to) amending the Subscription Price or the Value of the value of the Vouchers provided.
15. Legal Stuff.
    1. These terms and conditions are governed by South African Law.
    2. These terms and conditions shall include and incorporate by reference (as if part of these terms and conditions) any Privacy Policy or terms of use mentioned in these terms and conditions.
    3. Travelstart’s rights and obligations may be assigned or transferred to any other unrelated or related entity at any time.
    4. Once your Booking is made through Travelstart Plus. the Subscriber agrees that such services (booked using Travelstart Plus) are provided to You directly by the Travel Service Provider. Accordingly, under no circumstances will we be liable for any and all damage and/or loss caused by the Travel Service Provider or loss suffered as a result thereof.
